There is no amount of modification that permits someone to claim copyright in another party’s work without authorization.
Under 17 U.S.C. §§ 102 and 106, the copyright owner holds the exclusive rights to reproduce, display, distribute, and prepare derivative works. These rights arise automatically upon creation and do not require notice or registration for ownership.
Any unauthorized use — including copying, editing, cropping, recoloring, resizing, rearranging elements, adding text, labels, or annotations — constitutes an unauthorized derivative work and copyright infringement under 17 U.S.C. §501. Pursuant to 17 U.S.C. §103(a), no copyright protection attaches to any portion of a work created through unlawful use of another’s copyrighted material.
Commercial use of copyrighted material in product listings, marketing images, graphics, or advertisements is not protected by fair use under 17 U.S.C. §107.
Unauthorized use may result in DMCA takedown notices under 17 U.S.C. §512, removal of listings or accounts by online platforms, repeat-infringer enforcement, and federal copyright infringement claims under 17 U.S.C. §§ 411 and 504, including statutory damages. False claims of authorization or mistake may give rise to liability under 17 U.S.C. §512(f).
